New Jersey's top prosecutor steps down in the wake of appeals court rules against her appointment.

The ex-lawyer for the former president has resigned as New Jersey's top federal prosecutor. This comes after a legal ruling that challenged her eligibility to serve.

Official Departure

The head of the Justice Department, Pam Bondi, announced the prosecutor's departure on the start of the week. She commented that the judicial decision made it "untenable" for the official to perform her duties.

"But do not mistake adherence to the ruling as defeat," she declared. "This battle will now reach across America."

Legal Background

The departure follows closely on a judicial panel ruled that she had been unlawfully serving as the top prosecutor. This judgment is likely to affect numerous prosecutions in New Jersey.

The judicial panel said that a interim role that bypassed confirmation by the US Senate ran afoul of the federal law governing appointments.

Future Role and Reaction

It was also stated that Habba will stay on at the justice department as a senior adviser. She will seek further review of the disqualification, aiming for a reversal.

In a statement, Bondi wrote that the judiciary "must not second-guess the executive's selection of prosecutors entrusted with carrying out the primary duty of the administration of enforcing the law."

Performance in Office

Bondi praised Habba's record and said that under her leadership, the Newark saw a 20% reduction in crime. It was also reported that the Camden had its initial homicide-free summer since 1974 free from homicides.

Background and Previous Role

Habba, originally became part of Trump's personal legal team in 2021. She later defended the former president in his hush-money trial in New York last year, when he was conviction on multiple felony counts of document fraud.

Prior to assuming the top New Jersey post, Donald Trump had revealed he was naming her as his presidential counsellor during his second administration, labeling her as "unwavering in her loyalty" and a "tireless advocate for justice".
